4. Electronic Communications

You agree that electronic communications satisfy legal requirements that communications be in writing.

Clicking “I Agree,” creating an account, or completing a purchase constitutes your electronic signature under the E-SIGN Act.

5. Orders, Processing & Shipping

Orders are processed according to timelines displayed on the Website.

Delivery times are estimates only.

Title and risk of loss transfer to you when Products are delivered to the shipping carrier.

We are not responsible for delays caused by:

• customs processing
• weather events
• supply chain disruptions
• labor shortages

6. Subscriptions & Auto-Renewal

Cancellation

You may cancel your Subscription at any time by:

Cancellation becomes effective at the end of the current billing period.

Price Changes

We will provide at least 30 days notice before any material change in subscription pricing.

California and New York Subscribers

In accordance with applicable automatic renewal laws, including California Business & Professions Code §17600 and New York General Business Law §527-a, subscribers may cancel at any time and will receive confirmation of cancellation.

7. Returns & Refunds

Most Products include a 30-day money-back guarantee beginning on the shipment date.

Refund eligibility may require proof of purchase and return of Products.

Misuse of the refund policy, excessive returns, suspected fraud, or product diversion may result in:

• denial of refunds
• account suspension
• refusal of future orders.

Refunds are typically processed within 10 business days after returned items are received.

8. Billing Errors

You must notify us of billing errors within 30 days of the charge appearing on your statement.

Failure to notify us within this period constitutes acceptance of the charge to the extent permitted by law.

11. User Generated Content

You grant Oravance a worldwide, perpetual, royalty-free license to use, reproduce, distribute, modify, and display User Content for marketing, advertising, product development, and business purposes.

You represent that:

• you own or have rights to the content
• the content does not violate any law or third-party rights.

We may remove User Content at any time.

You waive any applicable moral rights in submitted content.

User Content may also be used to train or improve artificial intelligence or machine learning systems.

12. Influencers & Affiliate Content

The Website may contain affiliate links or sponsored endorsements. We may receive commissions from purchases made through such links.

Endorsements are intended to comply with FTC endorsement guidelines.

Users receiving incentives must disclose such relationships.

13. Product Information & Cosmetic Use

SNOW products are cosmetic oral-care products intended to improve the appearance of teeth.

Except where specifically labeled as an over-the-counter drug product with a Drug Facts panel, SNOW products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Statements on the Website have not been evaluated by the U.S. Food and Drug Administration unless required for regulated OTC drug products.

Individual results vary depending on oral health, hygiene habits, diet, and product usage.

Testimonials and before-and-after images represent individual experiences and are not guarantees of typical results.

LED Device Disclaimer

Safe Use and Sensitivity

Whitening products may cause temporary tooth sensitivity or gum irritation.

Products must be used strictly according to instructions. Excessive or improper use may increase sensitivity or irritation.

Discontinue use and consult a dental professional if discomfort persists.

No Substitute for Professional Dental Care

SNOW products are not a substitute for professional dental care. Individuals experiencing dental pain, gum disease, or other oral health issues should consult a licensed dental professional.

14. Individual Results Disclaimer

• use automated scraping tools

• engage in illegal conduct.

16. Unauthorized Resale

To the maximum extent permitted by law, Oravance’s total liability shall not exceed the amount paid by you for Products during the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, punitive, or lost-profit damages.

23. Indemnification

You agree to indemnify and hold Oravance harmless from claims arising from:

• your User Content
• violation of these Terms.

24. Informal Dispute Resolution

Before initiating arbitration or legal action, you agree to notify Oravance in writing at support@trysnow.com describing the dispute.

The parties will attempt to resolve the dispute informally for 30 days before initiating arbitration.

25. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Except where prohibited by law, disputes arising out of these Terms, the Website, or the Products shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).

Arbitration will occur in Connecticut unless otherwise required by law.

You agree that:

• arbitration will be conducted on an individual basis
• class actions, mass actions, and representative proceedings are not permitted

Either party may bring claims in small claims court where permitted.

Oravance may seek injunctive relief in court for intellectual property violations.

Arbitration Opt-Out

You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to support@trysnow.com.

26. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.

27. Sales Tax

Applicable sales tax will be applied at checkout where required by law.

28. Promotional Codes

Promotional codes:

• may be limited to one per customer
• may not be combined unless stated
• may be revoked if obtained improperly.

29. Assignment

Oravance may assign these Terms without notice.

You may not assign your rights without written consent.

30. Severability

If any provision of these Terms is found unenforceable, the remainder will remain in effect.

31. Entire Agreement

These Terms constitute the entire agreement between you and Oravance regarding the Website and Products.
